Operational control: what it is, what it should be, and how it relates to the right to privacy

Synteza:

  • In the Polish legal system, seven different types of services can request permission to conduct an operational control;

  • Each of the laws pertaining to these services specifies a closed catalogue of crimes to which operational control may apply;

  • The Anti-Terrorism Act has led to legalization of undercover surveillance of foreigners without court consent;

  • Courts and Tribunals - both domestic and international - have set minimum standards for balancing the need to conduct operational control with respect for civil rights and freedoms..
